Buying Residential Property

You have found a home or a building site that you want. Our lawyers will contact the vendor’s lawyer and get a copy of the title deeds for the property and the Contract.

The lawyer will then study the deeds for the property and make sure all legal formalities are taken care of and arrange for you to sign the Contract. They may insert Special Conditions into the Contract tailored to your specific instructions. Once the Contract is accepted, all title matters are in order and your lawyer has received the purchase money they will complete your purchase. They will then have the property registered in your name.

Selling Residential Property

So you are moving on and want it to happen as speedily as possible – then instruct Property Lawyer NI and your appointed lawyer will obtain your title deeds so that the contract will be signed as soon as you have agreed a price.

Your lawyer will get all of the contractual searches and property certificates and have you complete a questionnaire about your property that they will then forward to the purchasers lawyer. You will also complete a list of fixtures and fittings. We will also arrange for an Energy Performance Certificate if you have not already got one for your property. Through your lawyer you will agree a completion date with the purchasers lawyer that suits you. On completion, all mortgages, rates and ground rent (if any)   will be discharged and the balance of the sales proceeds paid to you.

Mortgaging

You require finance or just a better deal on your mortgage. You lender wants appropriate security for the borrowing.

The title must be in order – so inform Property Lawyer NI where your title is and we will commence inspection of this. We will apply for all relevant searches required by your lender. We will meet with you to ensure that you are happy to proceed with the mortgage offer. The title will be certified to your lender with the funds being used to redeem the existing mortgage (if applicable). The new charge will be registered against your title and your deeds sent to your new lender on conclusion.
